How does geographical indication registration proceed?
After filing, the Office examines the product's geographical boundaries, production method and distinctive characteristics. An acceptable application is published in the Bulletin; a three-month opposition window follows, and once oppositions are overcome the registration is granted.
Who may apply?
Producer groups, public institutions related to the product, professional chambers, and associations or cooperatives may apply. The technical specification accompanying the application is the most critical part of the process.
What is the difference between an appellation of origin and an indication of source?
For an appellation of origin, all essential characteristics of the product derive from a defined geography and production must take place there; for an indication of source, at least one production stage takes place in the defined geography.
How long does protection last - is renewal required?
Geographical indication registration is indefinite; no renewal is required. In return, the proprietor must demonstrate proper emblem use and the product's compliance with the specification through regular audit reports.
